General Terms and Conditions (GTC) of Pignon

We are pleased to see that you are reviewing our general terms and conditions. While this document may not be the most exciting read, it allows us to clarify what you can expect from Pignon and what Pignon can expect from you. To ensure complete transparency, when we refer to “we” or “Pignon,” we mean THE MASTSERS, 44120 Vertou, France.

These general terms apply when you place an order with us through the website pignonclothing.com.

We adhere to the mandatory consumer protection legislation in force and do not intend to exclude or restrict these rights through these terms.

  1. Applicability of These Purchase Terms:

The present General Terms and Conditions (GTC) apply to all orders placed on the platform of the clothing brand Pignon. By placing an order, you agree to be bound by these GTC. The applicable GTC are those in effect on the day the order is confirmed.

  • The products offered for sale are described with the utmost precision. However, the exact presentation of the products on the website cannot be guaranteed, particularly due to differences in color rendering or materials. Therefore, the visuals of the products do not have contractual value. In case of an obvious error in the description, the seller cannot be held liable.
  • We invite you to carefully read the descriptions and characteristics of the products before validating your order.
  1. Orders
  • Orders are placed exclusively online on the website www.PIGNONCLOTHING.COM. The customer must create a personal account to place an order. The customer must provide their contact details, address, email, and phone number. The customer must ensure the validity of their provided email address and check their email filtering rules to avoid PIGNON emails ending up in SPAM. All provided information must be accurate and updated in case of changes. Account management and personal information updates are done on the website.
  • When creating their account, the customer chooses a password to identify themselves and allow quicker logins for future site use. To ensure account security, the customer agrees not to disclose the password to third parties, take necessary precautions to prevent third-party access, not share the account with third parties, not use a third party’s account, use a personal email address, and allow PIGNON to contact them via this email address.
  • The customer is solely responsible for the use of their account. Any connection or data transmission made using their password will be deemed to have been made by the customer and under their responsibility.
  • To preserve the personal and confidential nature of their access, it is recommended to log out of the account at the end of each session.
  • In case of fraudulent use of the account and/or password, or loss or theft of the password, the customer must immediately inform PIGNON.
  • The customer is responsible and presumed to be the author of purchases made on or through their account.
  • Order validation implies acceptance of the GTC.
  • For any order exceeding 400 euros, we reserve the right to contact the customer to maximize the security of their purchases.

Placing Orders on the Platform

Eligibility to Order

To place an order on the Pignon platform, you must be of legal age in your country of residence and have the legal capacity to enter into contracts. You must provide accurate and complete information when creating your account and placing your order.

No Resale

Orders placed on the Pignon platform are strictly for personal use. Any resale of the purchased products is strictly prohibited. Pignon reserves the right to refuse or cancel any order suspected of being intended for resale.

How to Order

To place an order, select the desired products, add them to your cart, and follow the on-screen instructions to finalize your purchase. The choice and purchase of a product are the sole responsibility of the customer. The customer must add the selected products to their cart. The customer can verify the details of their order, the total price, and make modifications before final validation.

You will receive an order confirmation email once the process is complete. The customer agrees that the order confirmation will serve as proof of the contractual relationship with PIGNON.

If one or more ordered products are unavailable, PIGNON will inform the customer as soon as possible. The order may then be canceled, or a new delivery date may be proposed to the customer, subject to the subsequent availability of the missing product(s).

Our Right to Reject Your Order or Cancel a Contract

Order Validation:

Order validation by the customer is materialized by their acceptance of the general terms and conditions of sale (GTC), which they acknowledge having read by checking the appropriate box. The order is final for the customer from the time of their definitive validation, indicated by clicking “confirm and pay for your order.”

Pignon reserves the right to refuse any order or cancel a contract for legitimate reasons, in accordance with the provisions of Article L.121-11 of the French Consumer Code, such as errors in order information, suspicion of fraud, or product unavailability. If we reject or cancel an order, we will inform you by email and refund any amount you have already paid for that order.

Data Verification and Protection

Data Verification:

Pignon reserves the right to verify the information you provide before accepting your order. This may include verifying your delivery address, payment information, and other personal information to prevent fraud.

Personal Data and Confidentiality

Protection of Personal Data:

Pignon places great importance on protecting and respecting the privacy of its customers. Pignon is committed to protecting the confidentiality of your personal data. The information collected during the order is necessary for order processing and is used solely to process your order and improve your shopping experience. We do not share your information with third parties without your consent, except as necessary to process your order (e.g., with delivery service providers). The customer has the right to access, modify, and delete their personal data.

Price/Payment

Payment is made exclusively in euros, in full at the time of the order.

We may occasionally offer promotions, discount codes, and other deals. These offers are valid only during the specified period and under the conditions directly associated with them.

Payment Methods

Pignon accepts several payment methods, such as credit cards (Visa, MasterCard, American Express), debit cards, PayPal, and other methods indicated on our platform. You must provide valid and up-to-date payment information when placing your order.

PayPal Payment:

When validating their order, the customer must enter their PayPal email address and password. If the customer does not already have a PayPal account, they will be directed to a PayPal account creation page during payment to use this payment method.

Gift Card Payment:

The PIGNON gift card is valid only for purchasing PIGNON brand products and can be used for one year from the activation date, which corresponds to the purchase date. This card cannot be exchanged, refunded, or used for cash back. Gift cards can be cumulated up to a limit of 1000 euros and/or 5 cards.

Installment Payment:

The option to pay in installments via KLARNA is also available on our site.

KLARNA Payment in 3 Installments:

Interest-free payment in 3 installments is available online for orders over 150 euros. During payment, the customer is redirected to Klarna’s server to finalize their installment payment and obtain the details of their monthly payments. The customer will then be invited to review and accept Klarna’s terms of use and privacy policy. Payment security is ensured by Klarna and its service providers.

Payment Processing

All payments are securely processed by our payment service provider. Your payment information will be encrypted to ensure the security of your transactions. By placing an order on our platform, you authorize Pignon to debit your payment method for the total amount of your order.

Transfer of Ownership

Ownership of the products is transferred to you once full payment is received and the products are shipped. Until then, the products remain the property of Pignon.

The order will only be processed after payment validation.

Prices and Currencies

All prices displayed on the Pignon platform are in euros and include applicable taxes (VAT), unless otherwise stated. Prices may be changed without notice, but changes will not affect orders already accepted. Shipping fees are added at the time of the order.

Your Total Price

The total price of your order includes the price of the products, applicable taxes, and shipping fees, as indicated during the ordering process. You will receive a detailed summary of these costs before finalizing your purchase.

Delivery

Pignon ships its products to addresses in Europe. Delivery times vary depending on the destination address and the chosen delivery method. Delivery estimates are provided for informational purposes and are not guaranteed. Pignon is committed to shipping products as quickly as possible but cannot be held responsible for delivery delays.

Shipping Fees

Shipping fees are calculated based on the weight of the products, the delivery address, and the chosen delivery method. These fees will be displayed during the ordering process before you confirm your purchase.

Free Shipping

Pignon offers a free shipping option for orders over 200 euros. This free shipping method may take longer to reach destinations in Europe. Orders shipped via this method will be sent by the standard Colissimo delivery service. Delivery times may vary between 2 to 7 business days, depending on the exact destination and transport conditions.

Express Delivery

For customers who wish to receive their items more quickly, Pignon offers an express delivery option. This method guarantees delivery within 24 to 48 hours throughout Europe. Orders shipped via express delivery will be handled by Chronopost. Express delivery fees will be calculated based on the weight of the products and the delivery address and will be displayed during the ordering process. This option is ideal for customers who need their items as soon as possible.

Multiple Package Delivery

If your order contains multiple products, they may be shipped in separate packages, depending on their availability. You will be informed of multiple shipments and receive tracking numbers for each package.

Shipment Notification

Once your order is prepared and shipped, you will receive an email notification containing the tracking information. This email will include:

  • Your order number
  • The unique tracking code
  • A direct link to the carrier’s website to track your package

Real-Time Package Tracking

When you make a purchase on the Pignon platform, you will receive a confirmation email containing a unique tracking code for your order. This code will allow you to track the shipment of your package in real-time. Here’s how to proceed:

  1. Click on the tracking link in the notification email.
  2. You will be redirected to the Colissimo tracking website.
  3. Enter your tracking code in the appropriate field.
  4. View the updated information about the current location of your package and the estimated delivery date.

Delivery Issues:

If the customer is unavailable for delivery (e.g., missed delivery appointment, failure to pick up the package after a delivery notice), they will lose their contribution to the shipping fees. Return fees will also be deducted from the item’s refund. If the customer requests a new delivery, the shipping fees must be paid again beforehand.

Inspection Upon Receipt

Please inspect the products upon receipt and immediately inform us of any damage or defects. If you notice a problem, please keep all original packaging and documents and contact our customer service to arrange a return or exchange.

Warranties

The products are covered by the legal guarantee of conformity (Article L217-4 and following of the Consumer Code) and the guarantee against hidden defects (Article 1641 and following of the Civil Code). In case of non-conformity, the customer can request a refund or exchange of the product.

The customer agrees to follow the recommendations and instructions on the labels or packaging and acknowledges that Pignon will not be held responsible for any damage resulting from non-compliance with these recommendations. Pignon will not be held responsible for any damage caused by the products.

If Pignon is held responsible, the compensation will only apply to direct, personal, and foreseeable damages. In any case, Pignon’s liability will be limited to the amount of the order.

Returns and Cancellations

No unsolicited returns will be accepted. Any return must be notified to PIGNON in advance, following the modalities indicated below.

Order Cancellation Before Delivery

You can cancel your order as long as it has not been shipped. To do so, please contact us as soon as possible. If your order has already been shipped, please refer to our return policy for instructions on returning the products.

Return of Orders After Delivery – Defective Products

If you receive defective or damaged products, please inform us as soon as possible. You can return the products for a replacement or full refund. Pignon will cover the return shipping fees for defective products.

Return Conditions:

The customer can return their item after obtaining PIGNON’s approval, either by their own means or using the return label provided with the item(s) upon delivery. They must deposit the package with the printed label at a post office. As proof, the customer must keep the receipt of the package deposit provided to them.

Your Right of Withdrawal

In accordance with the law, you have a right of withdrawal of 14 days from the receipt of the products to change your mind and return the products without justification. The products must be returned in their original condition, unworn, unwashed, in their original packaging, and with all labels intact. Return shipping fees are the customer’s responsibility, unless the products are defective.

PIGNON reserves the right to refuse the refund of returned products if they have been visibly used or damaged by the customer, rendering them unsuitable for sale, or if the products do not correspond to the references declared for the return.

To exercise their right of withdrawal, the customer must notify their intention within 14 days of the purchase date or receipt of their order in a clear and unambiguous statement.

From the date of their declaration, the customer has 14 days to return the products in accordance with the previously mentioned conditions.

They must complete the form attached at the end of these GTC.

Refund Information

Refunds will be made using the same payment method used for the order, within 30 days after receipt of the returned products and verification of their condition. You will receive a refund confirmation email once the process is complete.

Pignon reserves the right to modify these GTC at any time. The modifications will take effect upon their publication on our platform and will apply to orders placed after their publication on the site. It is your responsibility to regularly review the GTC to stay informed of any updates.

Acceptance of Modifications

By continuing to use our platform after the publication of modifications, you accept the new GTC. If you do not accept the modifications, you must stop using our platform.

Intellectual Property

All elements published on the pignonclothing.com website – including, but not limited to, product photographs, logos, videos, trademarks, models, domain names, and text – are the property of SAS THE MASTERS and constitute works protected by intellectual property rights. Their use is protected by intellectual property rights and cannot be used without our prior written consent. Any unauthorized use, including in domain names, meta-tags, or advertisements, may result in legal action. Pignon actively monitors the use of its trademarks and takes immediate action to stop any unauthorized use.

Liability

Pignon cannot be held responsible for indirect damages resulting from the use of the platform or the purchased products, including, but not limited to, loss of profits, data loss, or business interruption.

Account Termination: Termination Conditions

Pignon reserves the right to terminate your account in case of violation of these GTC or any other Pignon policy. In case of termination, you will be informed by email, and any ongoing order may be canceled.

Site Usage:

The customer is responsible for the activities conducted from their online account and agrees to comply with the laws in force regarding the use of the site, including those concerning intellectual property protection.

Pignon is committed to ensuring the proper functioning of the site and the accuracy of its information. Pignon will make every effort to keep the site accessible but is under no obligation to do so. Pignon may interrupt access to the site for maintenance, corrections, and updates.

Access may also be interrupted for technical or legal reasons. Pignon reserves the right to cease publishing and close the site.

Pignon cannot be held responsible for any outages or viruses that may hinder the use of the site or for any direct or indirect damage.

COMMUNICATION AND CONTRACT CONSERVATION:

Pignon can provide the customer, upon request, with a copy of the product sales contract (invoice).

For online sales contracts, Pignon will ensure the preservation of the contract for 36 months from the delivery of the product.

Proof: Emails will serve as proof between the parties, as will the automatic registration systems used, particularly in case of a dispute.

Environment:

TRIMAN: The TRIMAN logo is derived from environmental regulations. The logo indicates that the product or packaging on which it is affixed is subject to sorting instructions. It is affixed to all consumer products collected by eco-organizations and whose recyclability is ensured. For Pignon, this includes its packaging, which must be sorted by the customer.

Other Important Terms

These GTC constitute the entire agreement between you and Pignon regarding purchases on our platform. If any provision of these GTC is deemed invalid or unenforceable, the other provisions will remain in effect.

Applicable Law/Jurisdiction

These GTC are governed by French law, and any dispute will be subject to the exclusive jurisdiction of the courts of the seller’s headquarters. By placing an order on our platform, you agree to submit to the jurisdiction of these courts.
